The Commissioner for Education, Chief Justice Emeritus Vincent De Gaetano, delivered an informative session to final year Bachelor of Arts Honours in Journalism students reading for that degree at the Malta College of Arts, Science and Technology (MCAST). The visit to the Ombudsman’s Office formed part of the students’ practical training within their module on institutional set up.
The session focused on the rule of law, judicial independence, and the right to good administration. Drawing on his experience as Chief Justice and as Judge, elected in respect of Malta, at the European Court of Human Rights, the Commissioner explored the meaning and importance of the rule of law in democratic societies.
The presentation examined the core elements of the rule of law, including accountability, equality before the law, legal certainty, access to justice, and the protection of fundamental rights.
The Commissioner emphasised that the rule of law is not merely a legal formula but an attitude that must guide all those who exercise public power.
Reference was made to relevant jurisprudence of the European Court of Human Rights and the Court of Justice of the European Union, as well as to the principle that there can be no regression in the protection of the rule of law within Member States.
The importance of an independent judiciary and of laws that seek justice was underlined as foundational requirements of democratic governance.
Students engaged actively in the discussion, reflecting on the practical implications of the rule of law for journalism, public accountability, and democratic oversight.
The students were accompanied by their lecturer, Dr Natalino Fenech. The visit provided an opportunity for direct engagement and a deeper understanding of the role of independent institutions in safeguarding the rule of law and fundamental rights in a democratic society.
