The Commissioner for Education, Chief Justice Emeritus Vincent De Gaetano, participated in the 5th Annual Symposium organised by the Procedural Law Unit of the University of Nicosia (UNIC), Cyprus, on the challenges of implementing the European Law Institute - Mt Scopus Standards on Judicial Independence (2024).
The ELI-Mount Scopus European Standards on Judicial Independence provide standards against which to measure judicial independence in a particular country and are intended to be relied upon by judges, civil society, and public authorities in European states. They build upon well-considered rules and practices commonly found in the constitutions and case law of liberal democracies and in international law to describe the fundamental components of judicial independence as understood and expected in European liberal democracies.
The symposium was held in collaboration with the International Association of Judicial Independence and World Peace (JIWP) at the University of Nicosia on December 11.
Serving and retired judges, academics and lawyers from Europe, the United States, South America and Israel participated in panel discussions which examined in particular the less obvious aspects of interference with judicial independence, such as interferences from within the judicial systems themselves or through methods of judicial appointment or promotion.
Chief Justice De Gaetano chaired one of the five panels, which focussed on the Role of the Judiciary in the Modern Era and the Promotion of Judicial Independence.
The proceedings of the symposium will eventually be published by the UNIC Procedural Law Unit.
